Terms of Service

2.1 Permitted Use

You may access and use our website for lawful business purposes, including browsing product information, submitting inquiries, and accessing resources related to our 3D printing filament products and manufacturing services. All use must be in compliance with applicable local, national, and international laws and regulations.

2.2 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Copying, scraping, or systematically downloading website content without prior written consent
• Attempting to gain unauthorized access to any portion of our systems, servers, or databases
• Transmitting malicious code, viruses, or any harmful or disruptive software
• Using automated tools to interact with our website in a manner that impairs its performance
• Impersonating Gensyn 3D, its employees, or any other person or entity
• Using our website for any unlawful, fraudulent, or commercially exploitative purpose

2.3 Website Availability

We strive to maintain website availability but do not guarantee uninterrupted access. We reserve the right to suspend, modify, or discontinue any part of the website at any time without prior notice.

3.1 Product Descriptions

Gensyn 3D offers a range of 3D printing filaments including PLA, PETG, ABS, TPU, PA, and PC materials in various colors and textures. We endeavor to provide accurate product descriptions; however, we do not warrant that all product descriptions, specifications, or other content are complete, accurate, or error-free.

3.2 Product Suitability

It is the Customer's responsibility to determine whether our products are suitable for their intended application. While our engineering team (30+ engineers) and R&D resources are available to provide technical guidance, final suitability determination rests with the Customer. We strongly recommend requesting samples before committing to large-volume orders.

3.3 Product Specifications

Product specifications, including material properties, tolerances, and performance characteristics, are provided for reference. Minor variations within industry-accepted tolerances do not constitute a breach of contract. We reserve the right to update product formulations for quality improvement purposes, provided that such changes do not materially alter the agreed specifications.

4.1 Order Confirmation

All orders are subject to written confirmation by Gensyn 3D. An order is not binding until we issue a written order confirmation or proforma invoice. We reserve the right to decline any order at our discretion.

4.2 Pricing

Prices are quoted in the currency specified in our commercial offer and are valid for the period stated. Prices are subject to change without notice prior to order confirmation. Quoted prices do not include applicable taxes, duties, freight, or insurance unless explicitly stated.

4.3 Payment Terms

Payment terms will be specified in the commercial agreement or proforma invoice. Standard terms require payment in advance or as otherwise agreed in writing. Gensyn 3D reserves the right to withhold shipment or production until payment obligations are fulfilled.

4.4 Order Cancellation

Orders may only be cancelled with Gensyn 3D's written consent. Cancellation of confirmed orders, particularly for OEM/ODM projects with custom tooling or materials already procured, may result in cancellation fees to cover costs incurred.

4.5 Delivery & Shipping

Delivery timelines are estimates and are not guaranteed. Gensyn 3D shall not be liable for delays caused by force majeure events, supply chain disruptions, or circumstances beyond our reasonable control. Risk of loss passes to the Customer upon handover to the carrier unless otherwise agreed.

5.1 Service Agreement

OEM/ODM engagements are governed by a separate Manufacturing Service Agreement or Purchase Agreement executed between Gensyn 3D and the Customer. In the event of any conflict between these Terms and a specific service agreement, the service agreement shall prevail.

5.2 Customer Responsibilities

• Providing accurate and complete product specifications, brand assets, and technical requirements
• Ensuring that all provided brand assets, logos, and designs do not infringe upon third-party intellectual property rights
• Timely review and approval of samples and proofs within agreed timelines
• Compliance with all applicable laws and platform policies in the Customer's target markets

5.3 Quality Assurance

Gensyn 3D maintains rigorous quality control standards across our 50 production lines. Customers may request quality inspection reports. Any quality claims must be submitted in writing within 30 days of receipt of goods, accompanied by relevant evidence.

5.4 Minimum Order Quantities

OEM/ODM services are subject to minimum order quantities (MOQ) as specified in the commercial quotation. MOQs may vary depending on material type, color, packaging requirements, and production complexity.

6.1 Gensyn 3D Intellectual Property

All content on this website, including but not limited to text, graphics, logos, product images, technical documentation, and software, is the property of Gensyn 3D or its licensors and is protected by applicable intellectual property laws. The "Gensyn" brand name and logo are proprietary trademarks. No license to use our intellectual property is granted by these Terms.

6.2 Customer Intellectual Property

For OEM/ODM projects, Customers retain ownership of their brand assets, logos, and designs provided to Gensyn 3D. The Customer grants Gensyn 3D a limited, non-exclusive license to use such materials solely for the purpose of fulfilling the manufacturing order. Gensyn 3D will not use Customer brand assets for any other purpose without explicit written consent.

6.3 Proprietary Formulations

Gensyn 3D's material formulations, enhanced material technologies, and production processes are proprietary trade secrets. Nothing in these Terms transfers any rights to such proprietary information to the Customer.

8.1 Aggregate Liability Cap

In no event shall Gensyn 3D's total aggregate liability to the Customer for any claims arising under or in connection with these Terms or any commercial agreement exceed the total amount paid by the Customer to Gensyn 3D in the three (3) months preceding the event giving rise to the claim.

8.2 Force Majeure

Gensyn 3D shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, supply chain disruptions, labor disputes, or transportation failures. We will notify affected customers promptly and work to minimize disruption.

9.1 Product Warranty

Gensyn 3D warrants that our products will conform to the agreed specifications at the time of delivery. This warranty does not cover defects arising from improper storage, handling, use outside recommended parameters, or modifications made by the Customer.

9.2 Website Disclaimer

Our website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be error-free or uninterrupted.

9.3 Third-Party Links

Our website may contain links to third-party websites for informational purposes. Gensyn 3D has no control over the content of such websites and accepts no responsibility for them. Inclusion of any link does not imply endorsement by Gensyn 3D.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. For international commercial transactions, the United Nations Convention on Contracts for the International Sale of Goods (CISG) may apply where relevant.

10.2 Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms or any commercial agreement, the parties shall first attempt to resolve the dispute through good-faith negotiation. If negotiation fails within thirty (30) days, disputes shall be submitted to binding arbitration in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC), or as otherwise agreed in writing by both parties.
